  • Gives you the right to live stream gigs, concerts and other events that are primarily about music.
  • The licence is required for live streaming any gig, concert or music event that is subject to a charge for consumers, regardless of the platform on which they are streamed.
  • The licence is also required for live streaming gigs, concerts or music events that are free of charge for consumers when the live streaming occurs via a platform other than a platform licensed by Teosto, in other words platforms subject to a charge or in Vimeo, Zoom or Teams, for example. Platforms licensed by Teosto include YouTube, Facebook, Instagram and TikTok.
  • The licence price includes the right to retain a live stream recording for later viewing for 30 days. If the recording is available for more than 30 days, you will need either a Minor Media Licence or a Production-Specific Synchronisation Licence for the time exceeding this limit (see which of these is more affordable for your purposes).
  • The number of viewing rights of events streamed live and the revenue from streams subject to a charge must be reported to Teosto using the reporting form. Music-related information is reported by the performer.
  • The performer does not need to submit a performance notification for free streams on platforms already licensed by Teosto (YouTube, Facebook, Instagram, TikTok) as the platforms report the works streamed to us. For streams subject to a charge, the performer must also submit a performance notification.
  • No basic fees, even with a valid licence: if you do not stream anything live, you will not receive invoices. Invoicing is based on the reports you submit to us.
  • If the music used is recorded music (a record or another reproduction), a separate licence is required for its use in addition to the Licence for Live Streaming. You can obtain a licence to use the reproduction from the phonogram producer, i.e. the record company. The record companies have different operating models and prices for the use of recordings and they decide these independently.
  • Information about the record company that released the record can be found on the physical record cover or in Spotify’s Show credits information under Source, for example. The record company websites and contact information can be found with Google, for example.

PLEASE NOTE! Further information on reproductions

  • A licence from Teosto is not required for live streaming that is free of charge for consumers using platforms already licensed by Teosto (YouTube, Facebook, Instagram), provided that the live stream is not recorded for later viewing. This also applies to gigs and concerts, which means no Licence for Live Streaming is needed for streaming them free of charge.
  • However, if a reproduction of a free live stream is stored on any platform, a Minor Media Licence or a Production-specific Synchronisation Licence is required for the reproduction (since there had been no need to obtain the Licence for Live Streaming for the stream, the right to record the stream and provide it for viewing for 30 days, provided by the licence, does not apply either).
  • Furthermore, private individuals do not need a licence for publishing reproductions via platforms licensed by Teosto.
  • A licence from Teosto does not guarantee that the content identification systems of different platforms will not block or interrupt the stream. Teosto has no influence on how the content identification systems of the above-mentioned platforms work.
  • The advantage of (domestic) service platforms subject to a charge over free platforms is the certainty that streaming will not be blocked or interrupted. Several domestic service platforms that are subject to a charge (e.g. G Livelab, SemiLive, TikettiStream and Keikalla.fi) also handle matters related to obtaining the Licence for Live Streaming and reporting music-related information to Teosto
    on the behalf of their customers.

Who is the licence intended for?

The licence is needed by a company, corporation or private individual who wants to offer live-streamed gigs, concerts or music events to consumers and possibly make them available for later viewing for 30 days.

What does the licence cover?

Live Streaming Licence, launched on 1 September 2021, gives you the right to offer live music performances to consumers using streaming technology (live streaming, streaming) on various platforms and services, and to offer a live stream recording for 30 days.

Streamed live performances may include, for example, gigs and concerts by artists and bands, as well as festivals and other events in which music is the principal content.

However, a licence from Teosto does not guarantee that the content identification systems of free global platforms will not block or interrupt the stream. Teosto has no influence on how the content identification systems of different platforms work.

How is the price of the licence calculated and what does it cost?

The compensation for using music in streams subject to a charge, i.e. the price of the licence, is a percentage of the revenue from the viewing rights. If the stream is free, the price is calculated by multiplying the number of subscribers for the live viewing rights by the amount of the minimum compensation stated in the price list. However, the compensation per stream always amounts to at least the minimum invoicing amount indicated in the price list.

The stream is considered subject to a charge if it entails, for example, viewing rights (admissions or other viewing fees) sold for the live stream or a recording thereof, donations requested from viewers or other similar income charged for the viewing right.

The price of the licence includes the right to offer the stream for viewing as a reproduction for 30 days after live streaming (on demand).

Reporting information to Teosto

The licence requires that the event and music-related information for live streams organised under the licence are reported to Teosto monthly in the Excel template intended for this purpose. The reports are to be submitted by email to medialicensing@teosto.fi by the 15th of the month following the live stream.

Each report shall provide the following information for each live-streamed performance:

  • date of live streaming
  • streaming platform
  • title of the live-streamed performance and name(s) of the artist(s)
  • number of subscribers to viewing rights
  • revenue from the viewing rights
  • titles of the songs performed and names of the creators of the songs (as a minimum, the name of the composer)

Several domestic service platforms that are subject to a charge (e.g. G Livelab, SemiLive, TikettiStream and Keikalla.fi) also handle matters related to obtaining the Licence for Live Streaming and reporting music-related information to Teosto on the behalf of their customers. The advantage of the above-mentioned service platforms over free platforms is the certainty that the content identification system of the platform will not block or interrupt the stream.

How and when is the licence paid for?

The price of the licence is invoiced per event based on the report for each event approximately two weeks after the report has been received by Teosto.

How long is the licence valid for?

The licence is valid until further notice. Even if the licence is valid, it will not generate invoices if there are no live-streamed events – see previous section.

VAT at current rate is added to the fee.

If copyright-protected music accounts for less than 1/3 of the total duration of the programme, 50% of the amount listed in the above price list (however, a minimum of EUR 28.66) will be invoiced.

Live Streaming Licence, special terms and conditions specific to the method of use

The right to use music under the licence is governed by these special terms and conditions for individual methods of use, as laid down by Teosto and Nordisk Copyright Bureau (hereinafter referred to collectively as “Teosto/NCB”) and Teosto’s General Terms and Conditions (hereinafter referred to collectively as “licence”).

Should a conflict arise between these special terms and conditions and Teosto’s General Terms and Conditions, these special terms and conditions have first priority, while Teosto’s General Terms and Conditions have second priority.

Definitions used in these special terms and conditions:

Live performance refers to the streaming of live music on the internet in real time (such as a gig by an artist or band or a festival, concert or some other similar performance), for which the customer offers consumers a viewing right for a fee;
On-demand refers to the method of file distribution, in which the consumer can stream a live performance at their chosen time and location but without the consumer receiving a permanent copy of the live performance.

Rights granted by the licence and period of validity

The licence covers the non-exclusive right to use music represented at the time by Teosto/NCB as follows:

  • the right to synchronise with an image and store on servers works included in live performances for the transmission right in accordance with the section below (hereinafter referred to as “reproduction right”);
  • the right to transmit works included in live performances to audiences in Finland streamed on-demand for a period of thirty (30) days from the time of the live performance (hereinafter referred to as “transmission right”).

The reproduction right and the transmission right can be used over a web service administered by the customer or a platform service provided by a third party. The reproduction right covers the use of works only in the service in which the live performance is immediately recorded by the customer.

The licence is valid until further notice.

Pricing

The price of the licence is specified according to Teosto/NCB’s licence price list effective at that moment.

Reporting

The customer must report information about live performances in accordance with Teosto/NCB’s reporting policy effective at that moment.

Other terms and conditions

The extent of the rights granted by Teosto/NCB with the licence may vary during the period of validity of the licence. Teosto/NCB can exclude from this licence works or rights associated with them that are no longer administered by Teosto/NCB.

The licence is of a pilot nature and will be offered temporarily for the period determined by Teosto/NCB. Teosto/NCB has the right to amend, remove or add to the terms and conditions of the licence, including the price lists, or to fully cease providing the products covered by the licence by notifying the customer a minimum of three weeks in advance.

The customer is responsible for ensuring that it complies with any terms of use of third parties. If the customer uses a platform service provided by a third party in its operations covered by the licence, the customer understands that any technical measures carried out by the service provider may affect the use of works in its service. Teosto/NCB is not responsible for the impact on the use of works resulting from actions taken by third parties.
The customer must perform the actions required to reproduce and transmit the works to the audience, as specified in the licence. The licence does not cover the use of works in circumstances that cannot be considered the customer’s operations.

The customer is obligated to protect, as far as possible by generally available methods and within reasonable costs, the works intended to be transmitted to the audience from use that violates the licence. However, this obligation of the customer does not, in any way, restrict the right of Teosto/NCB to place demands on third parties regarding the use of works in violation of this licence.
